Whether as a private individual or as part of a professional activity, it is essential that you take out certain types of insurance to protect against certain risks. 

In return for the payment of premiums, you become eligible for compensation in the event of an incident affecting your business or goods. Professional insurance is designed to protect you, your employees and your business in the event of difficulties linked to your business.

The Supplementary Pension Scheme for the Self-Employed (RCPI) is also known as an occupational pension plan. The “RCPI” policy has been available since 2019, with supplementary pension contributions paid by the self-employed. 

It enables self-employed professionals and company directors with self-employed status to build up additional capital for retirement. 

In addition, this pension scheme covers you against the risks of Death, Disability and Accident, while benefiting from an advantageous tax framework.

When a company causes damage or injury to another party, it owes full compensation to the victim, either: 

• Under common law (Civil Code) 

• By virtue of its commitments (contract, order, etc.) 

Although not compulsory for some companies, it is essential if you wish to avoid jeopardizing the long-term viability of your business and damaging your reputation. 

⚡Business liability vs. professional liability: key differences 

Business liability (BL) and professional liability (PL) insurance both cover damage suffered by third parties, but they differ in a number of respects. 

➡️ Business liability insurance: When the accident affects a third party. 

It covers damage caused to third parties during the company's day-to-day activities, with no direct link to your services. 

For example: 

  • Damage to a customer's equipment.
  • An accident suffered by a supplier on your premises.
  • Injury to a customer following the fall of an object in your offices. 

 

➡️ Post-delivery liability: When a loss is suffered by a customer, resulting from goods/services sold and delivered by the company.

Heating engineer: 3 days after installing a boiler, an error in connection by the heating engineer causes a company's boiler to explode. This results in personal injury (people in the company were injured), property damage (damage to buildings) and consequential non-material damage (business interruption for the duration of the work). These damages are covered by the post-delivery liability insurance policy taken out by the heating engineer. 

 

➡️ Professional liability: When a customer/third party turns against you.

It covers damage related to the purpose of your service, such as an error, fault, negligence or oversight. 

For example: 

  • A travel agency communicates the wrong flight times for a package tour, and customers miss the plane.
  • A customer puts their property up for sale. At the time of resale, the estate agent makes a mistake in the energy classification. A customer buys the property thinking it is perfectly insulated. In actual fact, it is an energy-guzzling property that needs major insulation work. 

It is compulsory for certain activities in Luxembourg (architectural firms and consulting engineers, travel agencies, estate agents, building managers).

Garage: The garage owner's customer hits the garage letterbox and the garage wall. As the garage owner's insurer, AXA takes recourse against the customer.
